These Terms of Use apply to the Festus Data Center Community Information Website, available at https://www.festusforward.com/, and to questions, comments, and feedback submitted to CRG through the website or other means regarding CRG’s data center construction in Festus, Missouri.

By using the site or submitting a question or comment, you agree to these Terms of Use and to the site’s Privacy Policy, which is incorporated herein by reference.

Submissions

You may submit questions, comments, and feedback through the website form. Submissions are intended solely for feedback and questions regarding the Festus, Missouri data center construction.

By submitting a question, comment, or other content, you grant CRG the right to use, reproduce, summarize, quote, publish, and publicly post your submission and CRG’s response in connection with the project and related communications. CRG will not publicly disclose any individual’s name, email address, city, ZIP code, or other identifying contact information when posting your submitted question and CRG’s response.

You are responsible for the content of your submission. You should not include sensitive personal information, confidential information, information about other people, or content that you do not want CRG to use as described in these Terms.

Acceptable Use

You may use the site only for lawful purposes and in a manner consistent with its limited purpose. You may not submit content that is false, misleading, unlawful, threatening, harassing, abusive, defamatory, obscene, discriminatory, invasive of another person’s privacy, infringing of another person’s rights, or otherwise inappropriate.

You may not use the site to submit spam, malware, advertising, solicitations, bulk messages, automated submissions, or content unrelated to the Festus, Missouri data center construction.

CRG may decline to respond to or post any submission if CRG believes the submission violates these Terms or is not appropriate for the site.

Managing Duplicative and Bad-Faith Submissions

Because residents may raise similar concerns, CRG may respond to a submission that substantially duplicates a question CRG has already answered—whether from the same person, a different person, or a coordinated campaign—by directing the submitter to CRG’s existing public answer rather than issuing a new individualized response.

CRG also reserves the right to decline to respond to submissions containing threats of violence, abusive or discriminatory language, personal attacks unrelated to the project, repeated submissions of the same question, or content that does not, in substance, pose a genuine question about the project. This does not limit pointed, critical, or skeptical questions about the project or CRG’s conduct. CRG will respond to such questions on the merits. These limited exceptions address the manner and conduct of a submission, not the viewpoint expressed.

CRG applies these criteria uniformly, regardless of the substance or viewpoint of a submission. This section does not limit any right to participate in applicable public comment periods, regulatory proceedings, or public records requests.

The site is provided for general informational and feedback purposes. Information on the site may be updated, changed, or removed at any time. Some statements posted on or responses provided through the site may include representations about anticipated timelines, construction activities, employment, economic impact, or other future aspects of the project. These statements reflect CRG’s current expectations and plans. They are not guarantees of future results, and actual outcomes may differ, including as a result of permitting, regulatory, market, construction, or other factors outside CRG’s control.

Changes to the Site or These Terms

CRG may modify, suspend, or discontinue the site, the submission form, or any part of the site at any time. CRG may also update these Terms of Use from time to time. Updated Terms will be posted on the site with a revised effective date.
